1. Acceptance

By accessing freenomad.net or using any Nomad service (hosting, publishing, AI radio, or content services), you agree to these Terms of Use and all incorporated policies.

2. Service Description

Nomad Moodle Initiatives Private Limited provides:

  • Hosting: dedicated Moodle LMS and BigBlueButton virtual-classroom hosting.
  • Publishing: interactive literature and visual novel publishing/distribution.
  • AI Radio: AudioUnites, a cloud-hosted internet radio platform (live broadcasting and AutoDJ playback).
  • Learning & Authoring: AI-assisted language learning tools and interactive content authoring.

You retain ownership of your content, branding, and data, and may export/migrate at any time.

3. Acceptable Use & Licensing

You agree not to publish, broadcast, or host unlawful, defamatory, infringing, or harmful content.

  • Copyright & Music Rights: for any broadcast content you are solely responsible for securing all necessary performance and mechanical reproduction licences (PPL, IPRS, Novex, or the relevant Copyright Society).
  • Intermediary Licence: you grant Nomad a non-exclusive, limited licence to host, transmit, and stream your content solely to operate the service on your behalf.
  • Intermediary Status: Nomad is a technical hosting intermediary and assumes no liability for the licensing status of user content. We may suspend service upon lawful orders or substantiated infringement notices.
  • AI Feature Restrictions: AI features do not grant or convey content/music licences.

4. Billing & Digital Delivery

  • Services are billed in advance (monthly/annual or one-time, as applicable) in Indian Rupees (INR) or supported currencies.
  • Digital Fulfillment: all services are delivered electronically immediately upon payment confirmation. Credentials and onboarding instructions are sent to your registered email, typically within 5–10 minutes. No physical goods are shipped.

5. Renewal & Failure (Soft-Grace Policy)

  • If a renewal payment fails, your service remains live during a 7-day grace window while automated reminders are sent.
  • If payment is not settled by the end of the grace period, the service is suspended (access disabled, configuration and data archived).
  • After cancellation or non-renewal, data is retained in archive for 90 days before permanent deletion.

6. Cancellation

You may cancel any subscription at any time via your dashboard or by emailing support@freenomad.net. Voluntary cancellation during an active billing cycle takes effect at the end of the prepaid period and does not trigger an automatic mid-cycle refund (see Refund Policy).

7. Limitation of Liability

Services are provided "as is" and "as available". Nomad Moodle Initiatives Private Limited shall not be liable for indirect, incidental, or consequential damages, or data loss, beyond the fees paid by you in the preceding billing month. All AI-generated outputs must be reviewed and approved by you prior to publication.

8. Intermediary Status & Content Takedown

Nomad operates as an intermediary under Section 79 of the Information Technology Act, 2000, and maintains a Resident Grievance Officer per the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

  • We act on lawful court orders or government directions (ordinarily within 72 hours).
  • Rights-holders may submit infringement notices; we provide the operator an opportunity to remedy before suspension.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts in Mumbai, India.

10. Modifications

We may update these terms; material changes will be communicated via email or an on-site notice.
